Welcome to Snakey. By downloading, installing, or using the Snakey application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using Snakey, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Snakey is a snake identification application that allows users to:

• Identify snakes using AI-powered image recognition
• Learn about snake species, their habitats, and venom status
• Build a personal collection (Snakdex) of discovered snakes
• Receive safety information and first aid tips for venomous species
• Earn XP, level up, and unlock badges
• Share snake discoveries as collectible cards

4. User Accounts

Snakey does not require you to create an account. Your collection data, XP, and progress are stored locally on your device. You are responsible for maintaining the security of your device and any data stored within the App.

5. Subscription and Payments

Snakey offers both free and premium subscription tiers:

• Free Tier: Allows a limited number of free snake scans with basic features.
• Snakey Pro: Offers unlimited snake scans, full collection features, and all premium content.

Premium subscriptions are billed through your Apple ID account. Payment will be charged at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel your subscription in your Apple ID Account Settings.

6. Free Trial

We may offer a free trial period for premium features. If you do not cancel before the trial ends, you will be automatically charged for the subscription. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

7. Refunds

All purchases are processed by Apple and are subject to Apple's refund policies. To request a refund, please contact Apple Support or use the "Report a Problem" feature in your purchase history.

8. Identification Accuracy and Safety

While Snakey uses advanced AI technology for snake identification, we cannot guarantee 100% accuracy. Identifications are provided for informational and entertainment purposes only. Critical safety notes:

• Do not rely solely on Snakey for safety decisions regarding snakes
• Always treat unidentified snakes as potentially dangerous
• Maintain a safe distance from all snakes
• If bitten by any snake, seek immediate medical attention
• Danger level assessments are general guidelines and may vary
• First aid tips are general guidance only - always consult medical professionals
• Regional variations in venom potency exist - when in doubt, seek help

9. User Content

You retain all rights to the photos you take using Snakey. By submitting images for identification, you grant us a limited license to process those images for the purpose of providing the identification service. We do not store your images after processing.

10. Intellectual Property

The Snakey App, including its design, features, code, snake information database, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.

11. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use automated systems to submit excessive identification requests
• Remove or alter any proprietary notices or labels
• Use identification results to approach or handle dangerous snakes

12. Disclaimer of Warranties

Snakey is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or free of viruses
• Snake identifications will be 100% accurate
• Danger level assessments will cover all possible risks
• First aid information will be suitable for all situations

Snakey is intended for informational and entertainment purposes only and is NOT a substitute for professional herpetological or medical advice.

13. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any personal injury or property damage resulting from:

• Your use or inability to use the App
• Reliance on snake identification or danger level information
• Any snake encounter, bite, or injury
• Any unauthorized access to your data
• Any interruption or cessation of the App

14. Data Loss

Since your collection data is stored locally on your device, you are responsible for your data. We are not responsible for any data loss that may occur due to device failure, app deletion, or other circumstances.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms.

16. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

18. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish its objectives to the greatest extent possible, and the remaining provisions will continue in full force and effect.

By using Snakey, you acknowledge that you have read these Terms of Service, understood them, and agree to be bound by them. You also acknowledge the inherent risks of snake encounters and agree not to hold us liable for any injuries or damages resulting from interactions with snakes.
